NSW:Labor defends Cherie Burton appointment

SYDNEY, April 8 AAP - The NSW Labor opposition has defended its decision to name an
MP who lost her driver's licence after being caught up in a drink driving scandal as its
portfolio spokesperson for healthy lifestyles.
The coalition government branded the decision, which was revealed on Friday as part
of Labor's front bench announcement, as "strange".
But Opposition Leader John Robertson said Cherie Burton, who will also represent volunteering
and fair trading in Labor's electorally depleted ranks, deserved a second chance.
"Cherie Burton is somebody who grew up in housing commissions," he told journalists.
"She was one of the youngest people to enter our parliament. She's a young mum with
two young kids, and she's earned a second chance."
When Labor was in government, Ms Burton was elevated to the front bench as housing
minister in 2005 before vacating the post after the 2007 election to sit on the back bench.
In 2010, she failed to take a breath test when stopped for a random roadside test and
lost her licence for one year.
The government's Special Minister of State Chris Hartcher said Ms Burton belonged on
the back bench.
"It's a strange message to send out to people," he told journalists.
"Someone who was obviously prepared to drink and then drive and this person has been
held up as healthy lifestyles (spokesperson)."
Labor's new 15-member cabinet will cover 40 shadow portfolios, with most of the MPs
responsible for three or four separate areas.
It comes after the party's resounding election defeat on March 26, which slashed its
caucus to just 34 MPs from 69 upper and lower house members in government.
"We are a smaller team but we will work twice as hard to hold the O'Farrell government
to account," Mr Robertson said.
"These are people who are all smart, they're talented, they are energetic and they're
ready to get on with the job."
Of the 15 shadow ministers named, nine have served in past Labor administrations.
The remaining six are fresh faces, some of whom have taken top portfolios such as health,
transport and the environment.
As was widely expected, respected former community services minister Linda Burney was
unopposed in her run for Labor's deputy leader.
"I'm incredibly proud and I thought long and hard about whether I had the capacity
and I was the right person to take on this role," Ms Burney told journalists.
She will also have responsibility for planning, infrastructure and heritage, sport
and recreation, the Hunter and the Central Coast.
Former premier Nathan Rees, who was rolled by Labor's right faction 16 months ago,
returns to the front bench as opposition spokesman for police, emergency services and
the arts.
"It's great to be back in the service," Mr Rees said.
Premier Barry O'Farrell said the choice of Macquarie Fields MP and paediatrician Andrew
McDonald was better late than never.
"We went through a procession of disastrous health ministers," he told reporters on Friday.
"It's only in opposition that Andrew McDonald finally gets a gig that he should have
gotten years ago."
But Mr Hartcher also said that keeping nine former ministers on the front bench showed
Labor has failed to heed the message from voters after its historic defeat.
"To have these sort of people now presented once again to the people of NSW as the
people who should be running NSW shows that Labor has learnt nothing," he said.
Former ageing and disability minister Peter Primrose was the only frontbencher from
the previous government not to secure a shadow portfolio.
Michael Daley, formerly police minister, has become Labor's treasury spokesman, former
deputy premier Carmel Tebbutt takes on education and training while former industrial
relations minister Paul Lynch secured the opposition roles of justice and attorney-general.
Mr Robertson added the roles of spokesman for western Sydney and the Illawarra to his
responsibilities.
The MPs' first act as shadow ministers was to visit a shopping mall in Hurstville in
the southern Sydney electorate of Oatley, which Labor lost in the election, to greet voters.

CANBERRA, Dec 19 AAP - The first memorial service for victims of last week's fatal
Christmas Island boat accident will be held before all their bodies are found.
Thirty asylum seekers, including 13 men, nine women, four children and four babies,
perished when their wooden boat hit rocks and shattered in heavy seas early Wednesday
morning.
A private memorial service organised by representatives of the survivors group, in
conjunction with immigration officials and an Islamic leader, was to take place on Sunday
afternoon (local time).
Further services are planned for Monday and beyond.
Although protests involving more than 100 distressed asylum seekers broke out on Christmas
Island on Friday, immigration department spokesman Peter Richards said he wasn't expecting
further action, just a "dignified, respectful" observance.
"It's a very difficult time for the survivors but for also other people within the
detention facilities," he said.
"There are a number that we've identified, for example, that have relatives amongst
this group (of deceased)."
Adding to their misery is the process of being interviewed and asked to formally identify
the victims.
Australian Federal Police Superintendent Gavan Ryan said that "excruciating" task was
under way, with about 15 bodies named so far and the rest expected to be identified soon.
"Some people react in different ways but it is an extremely traumatic thing to do," he said.
"It is very traumatic for everyone: everyone in the hospital, obviously, for the survivors,
the people who are there at the viewing."
Supt Ryan said he believed more bodies could be in underwater caves near the crash
site, but conceded the search for victims may be called off before they are all found.
"We are hoping by the end of tomorrow to have a definite answer of how many people
are missing," he said.
Supt Ryan said bad weather played a significant role in what led to the tragedy.
"I have no information from the survivors, or any other information, that the engine
was sabotaged in any way," he said.
However, a brief of evidence implicating the boat's crew in criminal offences is being
prepared and charges may be laid.
Immigration Minister Chris Bowen said counselling services were being offered to asylum
seekers on Christmas Island.
"We have flown in extra counsellors ... Those people in detention who have lost loved
ones, they are the particular focus of that counselling," he told reporters in Sydney.
Welfare group Life Without Borders was helping young people and orphans from the tragedy,
Mr Richards said, while immigration officials and police were trying to identify them
and find their families.
"At this stage, our focus is very much around the immediate health and welfare of this
group," he said.
"The issues around asylum and what eventually will happen with the survivors, including
the orphans, is something that it's too early for us to speculate (on)."
Meanwhile, the political fallout from the accident continues, with Opposition Leader
Tony Abbott saying it was time policies cracking down on people smuggling were implemented.
"There's no one change that will of itself stop the boats from coming, but there is
a range of policies that have been proven to work and we need to go back to (them)," he
said.
Mr Abbott advocated a return to temporary protection visas, offshore processing at
the Nauru detention centre and turning boats around when it was safe to do so.
"In the last five years of the Howard government's life, we had three boats a year,
not three boats a week," he said.
"Obviously, there is far less capacity for tragedy if there are far fewer boats and
far fewer people coming in them."
However, Nationals Senate leader Barnaby Joyce warned politicians against using the
tragedy as a policy springboard.
"(The public) will be very reticent if you try to use (the accident) as some sort of
moral bulwark or leverage to try and change the policy agenda to an issue about immigration,"
he told Sky News.
"It's self-evident that if you go and try and pin this one personally to someone in
Australia, no matter who that is, inside or outside the political field, then people will
call you for it."

NSW: Alleged serial sex attacker arrested after tip-off
Police say an alleged serial sex attacker accused of carrying out a string of indecent
assaults in Sutherland Shire .. Sydney's south.
The 34-year-old man was arrested outside a house in Renwick Street .. Marrickville
.. about 9pm (AEDT) yesterday.
He was charged with aggravated indecent assault .. theft .. and kidnap and is due to
front Parramatta Local Court today.
It follows four attacks on women in Woolooware .. Sutherland .. Kirrawee .. and Gymea
dating back to October.
During one of the alleged incidents a woman was shoved to the ground .. indecently
assaulted then robbed.
The arrest follows tip-offs received by police after a description of the alleged offender
and CCTV footage was circulated by the media this week.

Fed: Vindication for Bernie, but Hardie execs' fines 'too low'

SYDNEY, Aug 20 AAP - Asbestos campaigner Karen Banton has slammed as inadequate the
financial penalties handed out to former James Hardie Industries directors but claimed
vindication for her late husband Bernie, who spearheaded the fight for asbestos disease
victims.
Mrs Banton said she was disappointed that Hardie's former chief executive Peter Macdonald
was fined $350,000 for breaching the Corporations Act, and that former non-executive board
members, including Meredith Hellicar and Telstra director Peter Willcox, were fined as
little as $30,000.
"I would have liked to have seen the penalties be a lot higher," said Mrs Banton, who
is carrying on the battle for compensation started by her husband Bernie, the former Hardie
employee who died of asbestos disease two years ago.
"But I am very satisfied with the disqualifications."
NSW Supreme Court Justice Ian Gzell disqualified Mr Macdonald from managing a company
for 15 years.
Other former directors were disqualified for between five and seven years for their
part in deceptive and misleading conduct over the company's measures to meet its compensation
liabilities for asbestos disease sufferers.
"It sends a very strong message to corporate Australia that directors have accountabilities
and responsibilities, and they should not take on a directorship if they're not prepared
to be completely above board," Mrs Banton said.
Asked if the 10 Hardie executives had got what they deserved, she replied: "Certainly
their reputations are ruined for life.
"Really I feel for the barristers that were defending them, because how do you defend
the indefensible?
"No amount of money would have been adequate for their deceptions and misleading behaviour."
She said her late husband would not have been satisfied with the penalties.
"But he would feel vindicated.
He had a very strong faith.
"We are all going to be accountable one day, and there's not going to be any possibility
of appeals.
"These people are going to have to give account for their actions when they have finished
this life.
"If they haven't asked for forgiveness for their actions, then that will be a definite
day of reckoning for them, as it is for any of us."
Mrs Banton said she would continue to fight for a solution to the "temporary problem"
of a shortfall in the compensation fund caused by the global financial crisis.
"We want the company to remain viable and profitable because that is the only hope
for asbestos sufferers of the future to be compensated," she said.
Asked if the fines imposed on Thursday should be paid into the asbestos compensation
fund rather than to the commonwealth, she said: "We do not expect the taxpayer to bail
out the fund."
The Australian Securities and Investments Commission (ASIC) had asked the court to
disqualify Mr Macdonald for up to 16 years and fine him between $1.47 million and $1.81
million.
The company James Hardie NV was fined $80,000.

SA: Queensland floods bring new life to Lake Eyre

LAKE EYRE, AAP - The Cessna banks to the left, gliding alongside dramatic St Mary Peak
in Wilpena Pound, a natural amphitheatre of mountains north of Adelaide.
The red hills of the Flinders Ranges stretch out behind like the spine of an ancient creature.
"Isn't this something?" says Air Wilpena pilot Matt Graham into the headset. "You can't
really appreciate the majesty of this landscape in a car."
He's right about that.
Climbing up to 1,400 metres, the plane tracks northwest across the remote cattle country
of northern South Australia en route to Lake Eyre, Australia's famed salt lake that has
filled to capacity just three times in 160 years.
Those who know the area are buzzing.
This year has seen the first significant inflow of water since 2000, when the mad members
of the Lake Eyre Yacht Club last trimmed their sails and headed off for a day on the water.
Queensland's losses in the recent floods mean big gains for the parched Lake Eyre Basin,
as the flood waters wind their way south.
Everyone aboard the Cessna is keen to be the first to glimpse the crystalline surface
of the lake, especially Fraser McWaters and his wife Cecily, who have been planning this
flight for months.
"When I knew the water was coming I plotted the course so we could see the Warburton
Groove in flood," says Mr McWaters from Ulverstone in Tasmania.
"We rang up and booked. Money was no object."
Through the windows, everyone's following the contours and folds of the countryside
as they reach towards the horizon.
All the time the radio buzzes with the voices of pilots, the only sign that there are
other planes circling the lake, giving eager visitors the best view they'll ever get of
this part of Australia.
Some 90 minutes after take-off, our plane finally passes over the grand lake's smaller
sibling, Lake Eyre South, and descends to an altitude of just 150 metres, all eyes glued
on the horizon ahead.
From such a low position, the inflow can be clearly identified as watery fingers inching
across the salt to the shoreline.
"Bigger than Israel, about the size of Holland," someone mutters.
Small flocks of pelicans and seagulls take flight as they respond to the noise of the
plane, their bodies casting shadows on the blue brown water.
Over the next 60 days, thousands of waterbirds will be vying for nesting sites across
the sprawling Lake Eyre North.
Renowned bird expert Professor Richard Kingsford, of the University of NSW, says the
channel country is about to "go off" with more than 60 species of waterbirds birds known
to be heading south to the vast Lake Eyre Basin.
"Birds will be on the move in the next month or so," he says.
"After eight years of drought the spectacle will be fantastic, but I have to admit
to having concerns that the destruction of wetlands in the eastern states will have impacts
on the numbers of birds arriving."
As we pass overhead we can see terns, gulls and pelicans already staking claim to tiny
islands that emerge as the water invades - the perfect spots to rear young without the
threat of dingoes.
An estimated six million birds will make the pilgrimage this year along with other
wildlife, including camels and horses, drawn to the region by the water's scent.
The muddy water flowing into Lake Eyre North from the Warburton Groove, which is fed
by floodwaters streaming in from Queensland along the Diamantina and Georgina Rivers,
is entering the lake at a rapid rate.
But Professor Kingsford is not convinced the lake will fill this year.
Regardless, the McWaters are content with observing the effects of the inflow and the
wildlife it's already attracting.
"This is a once in a lifetime experience," Mr McWaters says. "Everyone should come and see this."
Indeed, many are.
By the time the Cessna flies into William Creek for a lunch stop there are already
10 planes parked alongside the dusty landing strip.
And the bar at the pub is full of chattering adventurers from as far away as Queensland
and Western Australia.
Scenic flights are expected to triple through to the end of July and tourist operations
from William Creek to Maree and as far south as Wilpena Pound are gearing up for a big
Lake Eyre flying season.
"Lake Eyre with water is something I never expected to see," says Matt Graham, the
Air Wilpena pilot.
"I have been flying in this area for three years, bringing scenic flights from Wilpena
every other day and I still get excited when we sight the first water in Bell Bay."

Victoria police have nabbed 33 drink drivers during a traffic blitz in Melbourne's
popular restaurant and pub districts.
A man in Clifton Hill recorded the highest alcohol reading of .131 .. while another
man in Clifton Hill was charged with theft of a motor car and evading police after he
tried to flee a booze bus.
Police tested two thousand 854 drivers at five booze bus sites in the popular restaurant
and pub suburbs of Clifton Hill .. Richmond .. Burnley and Fitzroy between 9pm on Friday
and five this morning.

FED: Aust tourists tell of another attack on Greek island
Two Australian brothers say they were savagely attacked on the Greek island of Mykonos
in almost identical fashion to the fatal bashing of Sydney backpacker DOUJON ZAMMIT.
DAN and BRAD HECKENDORF .. from Cronulla but now living in London .. have told Fairfax
newspapers how they were attacked on their first night on the island.
They say taxi driver called at least 15 Greeks with baseball bats .. batons and chains
after an argument about getting change from a trip.
The men demanded their wallets ..with BRAD able to run for help .. but 30 year-old
DAN was punched .. kicked and belted with the weapons for about 10 minutes in the attack
in July last year.
Meanwhile .. a 25-year-old nightclub bouncer has been remanded in custody by a Greek
court over MR ZAMMIT'S death following the confrontation on Mykonos.
News limited says the bouncer admitted in court he hit Mr ZAMMIT .. but claims he didn't
intend to kill him.
Friends and family will gather in Sydney tonight at a memorial service for the 20-year-old
.. with hundreds expected to meet at Cecil Hills Lake .. where Mr ZAMMIT played as a child
.. to light candles for him.

FED: Haneef will go all the way to High Court: cousin
A cousin of former terror suspect MOHAMED HANEEF .. says the doctor's prepared to go
all the way to the High Court to get his Australian work visa back.
IMRAN SIDDIQUI says the family realises yesterday's Federal Court victory may be just
a first step in a long legal battle.
Justice JEFFREY SPENDER quashed Immigration Minister KEVIN ANDREWS' decision to cancel
the doctor's visa .. but Mr SIDDIQUI says his cousin .. and the family .. are well prepared
for more legal action.
He's told ABC radio they have a very strong faith in the Australian judicial system
and are prepared to go to the High Court if necessary.
Mr SIDDIQUI says he hopes the minister will consider all the circumstances which have
changed since he made his original decision .. including the dropping of the charge against
Dr Haneef.
He says it's very important for the family to win the case.

Fed: Female comedians still face problems of the past

MELBOURNE, April 6 AAP - The stereotypes about women in comedy are well entrenched
- apparently tampon jokes, bagging out blokes and body image dominate.
It's a false image, stand-up comic Amelia Jane Hunter insists, as she discusses the
status of women in comedy.
But the perception that female comedians are some sort of underground society in the
world of comedy still exists in some quarters, despite claims to the contrary.
"Obviously that's where society is at the moment," says Hunter. "I hear people say
that and think, wow, way to convert the dominant paradigm.
"But you also have to remember, the people who go into a show with that perception
also watch The Biggest Loser, Home and Away and Desperate Housewives."
Hunter's one-woman show Amelia Jane Hunter is Keith Flipp has been bending minds and
pushing the limits of what is funny during the Melbourne International Comedy Festival,
which began last week.
It's a theatrical piece from a stand-up who refuses to conform.
She plays a person with three personalities, each with a sort of timeshare arrangement
that would make redistributing the Gaza Strip look as simple as paying an insult to George
W. Bush, a popular pastime at the festival.
It's an emotional journey, a challenging piece for the performer and the audience.
She recalls in mocking tones one man who told her: "I never thought women were funny
... but you're funny."
But she admits comedy means different things to different people. "It doesn't have
to be guys in T-shirts making amazing observations to which everyone can nod their head,"
she said.
"It's pushing the line of what's acceptable. Is a joke by a misogynist wife-beater
more acceptable than something from an obscure place that requires a bit of effort to
follow?"
Brisbane-based stand-up Meshell Laurie says it's the radio and television industries
which fan the perception that females have a tough time in comedy.
"TV and radio are still quite discriminatory and only decide they need a girl to balance
out their seven men," she says.
"But it's not like that in stand-up. That's what I love about it. Stand-up is where
you can be any type of person and have a career."
Terry Psiakis, whose latest show Unavailable follows her piece last year called Available
- since then she's found a bloke - says for people to say female comedians aren't funny
is like saying "black chickens lay bad eggs ... It's just bullshit basically."
But the numbers aren't friendly.
In 1997, only 14 per cent of performers at the Melbourne International Comedy Festival
represented the dominant X-chromosome.
Last year, the figure had risen to 33 per cent, but that appears to be the peak, or
at least the modern day standard.
Among the record 282 shows at the 2007 festival, 30 per cent are from women.
Emma Powell, creator and one of the stars of D-Cuppetry, a woman's answer to Puppetry
of The Penis, says history makes it harder for women to find comedic material.
The D-Cuppetry show is all about "women's material", about subverting the idea of perfection
thrust upon modern society and encouraging women to be proud of who they are. It also,
as Powell says, "teaches men how women feel about their breasts rather than just being
people who feel them", but it has been a runaway hit since last year's festival.
"There's still this idea that women can't make a fool of themselves and some sort of
subconscious reaction that people have when women's issues come up in a show that makes
them switch off," she says.
"We've come a lot further than the 1950s, but there's still a bit of The Stepford Wives
syndrome."
While Laurie's latest show, A Shadow of My Former Self, deals with her mental attitude
towards body image rather than weight loss, Psiakis says she avoids such topics if she
can.
"I try not to do that so called `women material', because, one, it's been done to death
and I'm not bringing anything new to it and, two, why reinforce that stereotype that all
women talk about is periods and having kids and bagging men? That's just such crap. There's
so much more to talk about," says Psiakis.
"I think you're really limiting yourself if you talk from a stereotypically female perspective."
The blue ribbon event at the festival each year, the Oxfam Community Aid Abroad fundraising
gala, may have been a rollicking success, but it highlighted the sexual inequality in
comedy.
Among more than 20 acts, which can be seen on Network Ten on Monday, April 16, just
four were female stand-up acts.
Of the four, only British-Iranian Shappi Khorsandi didn't feature "women material",
with her routine revolving around being Iranian and having a funny name.
Australia's Fiona O'Loughlan, a highly regarded comic internationally, delivered her
trademark schtick about being a neglectful mother and a bad wife.
There was Corrine Grant, best known for her TV work on The Glasshouse and Rove Live,
whose most memorable moment was when she grasped her breasts firmly, and challenged why
such a move would be offensive. It wasn't.
If there was a moment anyone fell flat on the night, it was Meshell Laurie and her
musing about the type of materials which could make the female genitalia more appealing.
While this isn't necessarily a representation of their body of work, or what women
deliver on stage in general, this sort of material only fuels the stereotype, Hunter says.
"Comedy is an asexual community, it's your own fault if you fall into a stereotype," she says.
"If you want to get up and do dick or fanny jokes, you can, but you're cutting out
half of your audience."
At the same time, dick and fanny jokes, as she says, can have a place if the performer
has engaged in the correct level of foreplay, described by Hunter as "charm".
"A lot can be said about charm," she says. "If you want to hit the audience with a
tampon joke they'll love it, as long as you've charmed them first."
Now a fixture of the Melbourne festival, Up Front is a night exclusively featuring
female comedians and it routinely sells out.
While Psiakis says the event was born out of necessity, it is now a celebration of
how far women in comedy have come.
"Now it's more of a pointer to say how many female comedians there are and how funny
they can be," Psiakis says.
Despite working in radio, the industry she says is yet to cotton on the sexual equality,
Laurie says her career has been an exception to the apparent rule.
"I've never felt discriminated against in the industry or anything," she says.
"I actually think most male comedians are pretty effeminate, they're a pretty girly
sort of bunch themselves so I've never felt put down by them."

Minister Amanda Vanstone might lose her job in a ministerial reshuffle is news to him.
Conjecture about Senator Vanstone's future intensified today with the Australian newspaper
reporting that some ministers were moving to have the colourful senator dumped from her
portfolio and from the Cabinet.
It follows speculation that Prime Minister John Howard would reshape his team before
Christmas, in the wake of the Labor leadership change.
"I have no idea whether there'll be a reshuffle or not. That is entirely a matter for
the prime minister," Mr Downer told ABC radio.
"As far as Senator Vanstone is concerned, she's a friend of mine, she comes from South
Australia and I'm a South Australian.
"I think she's done a very solid job as a minister.
"So I have no expectations about Senator Vanstone being demoted."

The Treasurer's rejected a business report that says the federal government's budget
surplus projections are out by an average of 255 per cent.
PETER COSTELLO's told ABC radio the report by the Business Council of Australia is
completely wrong.
His comments come after the government revised this financial year's predicted surplus
to 11.5 billion dollars .. that's 2.6 billion higher than it predicted in May.
Mr COSTELLO says the variation's marginal out of a total budget of 200 billion dollars.

Fixer rescues cash from child-care card
Dear Fixer: I have been a member at the Fitness 19 health club in Buffalo Grove for more than three years. Over a year ago, I purchased a $50 pre-paid child-care punch card that I have in my possession. I've used it infrequently and have a $37 balance on the card.
When I brought my kids in recently, I found out that the kids club was closed without any notice to the members.
The "safe and secure" kids club is prominently featured on the front page of the Fitness 19 Web site.
When I inquired about a refund, I was told that even though I had the card, I would also need a receipt to prove I had purchased it. I didn't keep that receipt from a year and a half ago. Again, I have the actual card in my possession.
If you can get my money back, I would like to donate the $37 to The Fixer's charity of choice. And I'd challenge the manager of the club to match it (no receipt required).

Scared of job scams
Dear Fixer: I am recalling a column you wrote last year about all the work-at-home job scams. I am now paranoid about everything that I see on the Internet regarding jobs. Is there any way to verify whether a Web site is legit?

Dear Sarah: A little paranoia is probably healthy when it comes to employment scams. These cons are among the slimiest out there because they prey upon people who are hoping to find work in a not-so-great economy.
But rest assured, there are ways to avoid the scams while landing your dream job. We took your question to Steve J. Bernas, president and CEO of the local Better Business Bureau. Steve has seen it all. Here's his advice:
If the employment Web site charges a fee for information on how to work at home or if they want your credit card information, it's a fraud, plain and simple. As Steve says, "You should not have to spend money to make money" — at least in the case of landing a job.
Sometimes employers are looking for a small amount, such as $10 for an application fee. But if 50,000 people fall for it, that's $500K for the scammer.
Ditto for companies that bring you in for an interview and then ask for money for materials or training.
In addition, CareerBuilder.com reminds job-seekers to never give out their Social Security number or other non-work-related personal information (eye color, marital status, etc.) that could be used for identity theft.
Steve also told us that some scammers will steal job-seekers' e-mail addresses from legitimate job Web sites, then contact them privately. If you get an e-mail out of the blue offering a wonderful job, it's probably a scam.
Travel tip

ComEd demand jolts building owner
Dear Fixer: I own a 12-flat in Alsip. ComEd sent me a letter Jan. 11 saying their records indicate there was installation of additional or non-standard equipment in the building.
Now, they want another $400, plus $17 more each month.
Each unit pays its own electric bill and I pay for the electricity in the laundry room, hallways and other common areas. Aside from regular upkeep, I haven't made any changes to the electrical equipment.

Dear Dan: You told Team Fixer you called ComEd a few times, wanting to know what equipment the utility thought you had installed. Each time, you were told you'd get a call back explaining the additional bill, but you were still waiting for that call when you contacted us.
We got in touch with ComEd spokeswoman Krissy Posey and asked if they could look into it. It turns out the company made an error during a recent routine audit at your building.
Posey said that during the audit, ComEd incorrectly identified a second electrical transformer as serving your property. "However, upon further investigation, ComEd determined his property is only serviced by one transformer," Posey told us.
Your records have been updated, and the additional charges should be zapped from your bill.

Refund retrieved from canceled credit card
Dear Fixer: I am a retired 84-year-old man. I had colon cancer two years ago and had surgery and treatment. My children did not feel comfortable with me being alone, so I contracted with BrickHouse Security for one year.
There was an equipment deposit of $199. When the contract ended in June 2009, I sent the equipment back and asked for my deposit.
After waiting for a few months, I contacted BrickHouse in September 2009 to try again to get my money. After many calls, their representative finally processed the refund that November.
The problem is they put the refund back onto a credit card that I had already canceled.
So, I contacted Chase, which had issued the card. They told me I would have to write a letter to United Visa's correspondence department.
I sent the letter with the closed account number and refund number. No luck. So I tried BrickHouse again and explained the difficulty I was having. This was last spring. A manager at BrickHouse said he would ask their finance department to issue a check. But when I called again later to ask about the check, I was informed that the manager had left the company.
The rep at BrickHouse said I should try the bank again because once the refund has been issued, the problem is not theirs anymore.
So I went back to Chase. Finally, last June, I spoke with a Chase supervisor, who said she would look into it. I still have not heard back. Please help me get my money back.

China sets up an Internet information regulator.(TOP NEWS)
China has set up an agency for monitoring Internet-related information, according to a report in Xinhua. The State Council General Office announced that this agency will be known as the State Internet Information Office and will coordinate and direct web content. It will also oversee the development of web videos, Internet streaming, and audio, among others. In addition, it will impose penalties on Web sites that breach norms and guidelines and help telecom operators boost the process of IP address distribution, domain name registration, and Internet provision.
CBS.com Names Goodwill Employee as Undercover Boss Employee of the Season Winner.
Anthony Cornell, an employee of Goodwill Industries of Northwest North Carolina, has won the Undercover Boss Employee of the Season grand prize of $5,000 on CBS.com.
The group said Cornell is the manager of a JobLink/Career Connections Center in Winston-Salem, NC. He and his staff help people in their local community receive the services they need to earn jobs and build fulfilling careers. Through Anthony's hard work and leadership, he has helped more than 400 people earn jobs in his community in the last year.
Cornell was nominated for the CBS.com contest by colleague and friend Tanika Hawkins. "His dedication inspires us all to do more, and that is what makes him a valuable employee," said Hawkins in her nomination video.
According to a release, Cornell was diagnosed with cerebral palsy at the age of two years old. He started working at the Winston-Salem Goodwill 14 years ago as a part-time employee and worked his way up to his current position as manager. He and his staff work with people in the community who are expanding their skills and looking for employment. The services offered at the center include resume writing assistance, personalized career counseling, help with cover letters, job search assistance, networking workshops, interviewing skills training, and access to computers and Internet.
"Many of our friends and neighbors are still feeling the effects of the economy and unemployment. Goodwill employees like Anthony Cornell are working tirelessly to help these people earn jobs," said Jim Gibbons, president and CEO of Goodwill Industries International. TiVo strikes black ink for the first time.(TiVo Inc. reported its first ever quarterly profit)
TiVo, despite a net loss in subscribers, reported its first ever quarterly profit, which it achieved by cutting expenses.
Last year TiVo lost DirecTV, its largest customer, when DirecTV decided to get third-party manufacturers to make DVRs based on a design from News Corp's NDS.
Since then, Tivo has operated on three fronts:
- Increase sales of TiVo boxes to consumers by adding new features.
- Try to land other pay-TV operators by licensing them to use its software and service on DVR hardware from other manufacturers. It has such deals with Comcast and Cox and a hybrid sort of development deal with Australia's Seven Media Group.
- Generate advertising income with specially targeted long-form ads. TiVo CEO Tom Rogers said the company expects its advertising business to grow with the number of subscriptions.
TiVo's future as a maker of DVRs seems limited because the pay-TV services have the inside edge when it comes to selling them to their existing subscribers and they prefer not to buy gear from TiVo.
For the first quarter, TiVo reported net income of $835,000, which compares with a year-earlier loss of $10.7 million. Revenue for the quarter, which ended April 30, increased 6.4% to $60.4 million from $56.8 million a year ago. Service revenue went from $54.2 million from $47 million. Technology revenue dropped to $3.93 million from $8.08 million. Hardware revenue increased to $2.29 million from $1.72 million a year ago.
General and administrative expenses dropped from $15.1 million to $11.2 million during the latest quarter.
TiVo ended the quarter with 4.34 million total subscriptions, down from 4.42 million a year earlier. Its monthly churn rate was 1.1%, up from 0.9% a year ago but down from 1.2% in the prior quarter.
For the second quarter, TiVo is projecting a loss of $5 million to $8 million and service and technology revenue of $57 million to $59 million.
TiVo initiatives include:
- Bundling its services with EarthLink's Internet connection services later in 2007.
- The Comcast and Cox deals, which have not yet been widely deployed, but will allow the pay-TV operators' subscribers to pay extra to get the TiVo service and software.
- The Amazon Unbox on TiVo, in which full-length content is downloaded to a TiVo box, where it can be shown on a connected TV rather than a PC.
- Seven will market TiVo products and services in Australia and New Zealand. There was some wording in the TiVo-Seven announcement that seemed to indicate that the TiVo boxes Down Under would also include access to videos that were delivered over the Net.
- Continued development of a lower-priced, mass appeal HD capable unit.
- An advertising program that launched in early May to point out unique features of TiVo's boxes and service, seperating TiVo from "generic" DVRs.
- Progress on the advertising front, with ratings data in DVR households taking hold as an important measurement tool for advertising by the multibillion-dollar television industry. IPG and Starcom have purchased subscriptions to TiVo's Stop||Watch Ratings service, which provides second-by-second, time-shift, program and commercial DVR ratings data.
There's a big pot of gold that TiVo thinks awaits it in the courts. It believes its many DVR-related patents will win out in the legal battle it's having with EchoStar. EchoStar operates the DISH satellite service and is a partner with AT & T in the telcos' pay-TV efforts. TiVo said it's moving closer to a resolution at the Federal Court of Appeals, which ruled in October that EchoStar could continue to offer its digital-video recording service while it appeals an earlier jury decision that it had infringed on TiVo's patent.

GOGGLES WOULD PUT SURGERY IN FOCUS.(CAPITALAND RPT)

KETTERING, Ohio -- The future of brain surgery just might be strapped around a plastic foam bust in an operating room at Kettering Memorial Hospital.
The helmet-like device with square-framed goggles and reflective lenses is waiting to play its part in another operation.
``It is going to be useful,'' said neurosurgical specialist Tim Gillum, who has worn the device during an operation. ``Nobody else I know of is using this technology.''
The goggles project computer-generated images and data into the surgeon's eye. Called Virtual Retinal Scanning technology, it uses low-power laser beams to paint rows of pixels onto the retina, creating a high-resolution, full-motion image that appears to be an arm's length away.
The prototype, which is being tested by the hospital, is designed to allow surgeons and surgical assistants to operate without having to stop and look up at computer screens to read a patient's vital signs, tumor scans and other data that could affect the operation.
Martin Satter, a physicist with the hospital's Wallace-Kettering Neuroscience Institute, said surgeons sometimes have to swivel their heads so often, it looks like they're watching tennis.
``We were looking for some new technology to kind of break through this problem,'' he said.
Satter checked the Internet and found the Web site of Microvision Inc., a Bothell, Wash.-based company that made retinal-display products for the military.
Satter talked the company into developing goggles for the medical field. Several members of Congress helped get funding for the project through a cooperative agreement with the Air Force.
U.S. Rep. David Hobson helped hospital officials get $4.9 million in federal money to help fund the project. The Ohio Republican has long been interested in transferring technology developed by the military to the private sector.
``This looked to me like a good one,'' said Hobson. ``I thought it was a win-win for everybody.''
E-Loan Tweaks Its Media To Get Its Message Across.
For the past few years E-Loan Inc. has been engaged in some high-profile consumer advocacy campaigns on the issue of privacy.
But the company says those efforts have not resonated well enough with consumers, so it is putting together a multimedia image-oriented campaign set to kick off in early April. One goal is to promote practices that E-Loan believes are more pro-consumer than those of its rivals.
At the same time, E-Loan is cutting prices on some home equity lines to prime borrowers to gain share in that popular market.
On Jan. 5 the Pleasanton, Calif., company announced the hiring of a new advertising firm, Merkley & Partners of New York, whose clients include Jet Blue, Mercedes-Benz, and Pfizer. The same day it announced it had hired a media consultant, Hill, Holliday, a Boston unit of Interpublic Group of Cos. Inc.
Chris Larsen, E-Loan's chairman (and until very recently its chief executive as well), said in an interview last week that the company has "always had an incredibly strong core culture of being radically pro-consumer ... but people don't quite get that from the ads. I don't think we've ever nailed the messaging."
E-Loan plans to spend $58 million on the campaign, which will use television, radio, the Internet, and billboards.
Mark Lefanowicz, to whom Mr. Larsen handed the CEO reins on Feb. 17, said one practice the campaign will highlight is that E-Loan does not compensate its salespeople according to the interest rate they charge consumers for home, auto, and other loans.
Mr. Larsen said Progressive Casualty Insurance Co. and Charles Schwab & Co. Inc. have done a good job of calling attention to their efforts to protect consumer rights.
Mr. Lefanowicz said one way E-Loan will try to do that is by buying longer television spots (currently 15 seconds) and using the Internet and satellite radio extensively.
It plans to spend $3.7 million on search-word advertising this quarter alone, he said. This type of advertising has been effective for E-Loan, he said.
The company has also partnered with auto research Web sites. Mr. Lefanowicz said 75% of car shoppers use the Internet in their search.
"If you're around when they're doing that, you have a chance to give them a loan," he said.
In December, E-Loan became the primary provider of auto loans for Edmunds.com and began offering car loans through eBay Inc.
E-Loan says eBay Motors is the top automotive Web site by annual gross merchandise volume.
Last week E-Loan lowered rates on home equity lines of credit for the most creditworthy borrowers -- starting at the 740 to 760 FICO score range -- to prime minus 62.5 basis points. He said the old rate was prime minus 50 basis points and that the company is considering lowering its rate to prime minus 75 basis points on loans with higher balances.
Mr. Larsen, who freed himself from day-to-day responsibilities by making Mr. Lefanowicz his CEO, said, "Every lender has gotten so cynical. Their attitude is " 'Bring them in, and we'll screw you any way we can,' " he said.
"There are a lot of people that are completely being ripped off."
Mr. Lefanowicz said that thanks to the new consumer advocacy campaign and the revamping of its capital markets operations last year, E-Loan still has plenty of room to grow.
Its fourth-quarter net income soared 81%, to $1.04 million, or 2 cents a share, from a year earlier. Analysts had been expecting another break-even quarter.

High style for Top Man; Designer Roger Walker-Dack had fallen in love with a London apartment, but he still stripped it bare to create his own dramatic look.

Roger Walker-Dack is a man who makes big decisions quickly - then he acts on them just as fast. When the fashion designer and entrepreneur saw a London apartment on the Internet he knew he had to have it - even though he was living in South Beach, Miami, at the time.
Within 24 hours he had flown to London, viewed the property and put in an offer which was accepted.
'I just made up my mind,' Walker-Dack says of his plans two years ago to move into the five-storey former Royale Greeting Card print works in Islington.
The property, which was converted in the mid-Nineties, was in perfect condition, but he stripped out all the fittings anyway. 'I have very strong ideas,' he says. 'And I wanted it to be dramatic.' The loft-style space certainly makes a bold first impression. A huge 10ft acid-etched door, made-to-measure by Preedy Glass, slides back to reveal a large living space with a 12ft-high concentric ceiling supported by huge industrial pillars.
The shell houses a spacious one-bedroom apartment with white plaster walls and maple flooring. One wall is dominated by generous windows with French doors that lead out on to a roomy balcony overlooking the Regent's Canal.
Walker-Dack was born in Harpenden-Hertfordshire. His design success-led to the production of his own suit label, Roger Daq, which sold in New York, Tokyo, Paris and London.
He also helped launch menswear chain Top Man.
When he is not in Miami, Walker-Dack, 55, lives in his Islington flat so he can work on his next Designer Warehouse Sales. The sales, which have been running since 1987, give the public a chance to pick up cutprice designer clothes. Time Out magazine listed them as one of the top ten reasons for living in London.
Although Walker-Dack admits the flat was 'expensive, but property prices are ridiculous'. He won't say how much it cost. But local estate agents say one-bedroom apartments in the block sell for between [pounds sterling]250,000 and [pounds sterling]300,000, with an extra [pounds sterling]18,000 for a garage.
Walker-Dack's vision was made possible by his friend and architect John Guest. As well as sharing a designer's discipline for detail, he personally carried out the work to Walker-Dack's meticulous standards.
A dark cherrywood floor was ripped out and replaced with a maple one to make the space lighter. Low-voltage square lights were recessed into the walls to create subtle lighting. The exposed brick wall on the canal side of the building was plastered and painted white to simplify the look. It was painted one of the six shades of white found in the living area.
'I have a friend who is a colour consultant for the fashion industry,' says Walker-Dack. 'He told me that using the different tones of white exaggerates the light and shade of the room, which emphasises the shape.'
A sculptor did the decorating and the painting was precise - the only way Walker-Dack could tell it had been done when he arrived home in the evenings after work was by the smell of fresh paint.
Walker-Dack wanted the place not only to look stunning but to work on a practical level as well. The simple shell was a perfect backdrop for his collection of paintings, photographic portraits and fashion prints.
A narrow ledge was installed round the edge of the room so the pictures could easily be rotated without the hassle of having them rehung.
The apartment reflects Walker-Dack's fastidious nature. 'I hate stuff being out,' he says. 'Some would say I am neurotically neat.' Floor-to-ceiling closets were built to store spare works of art, Walker-Dack's extensive wardrobe and anything else that would offend his taste - like books. 'I don't see the glamour of having loads of bookcases,' he says, 'I don't live in a library.'
When Walker-Dack bought the property the bathroom was new, but it was far from his liking. 'It was too white, too wow and too grand,' he says. He stripped out the half-size bath and fittings and replaced them with a shower, fossilised limestone wall tiles, river slate floor tiles and a basin from West One Bathrooms. The kitchen, which is in a corner on the canal side of the property, has also been overhauled.
'Even though I hate the fuss of cooking, it was still important that the kitchen was functional, while at the same time retaining a clean and simple look. So I decided to take out stupid things like the extractor fan because it was ugly,' says Walker-Dack, who prefers to eat in restaurants.
Blue and white splashback tiles were removed, a stainless steel sink was replaced by a porcelain one from Habitat. Habitat wall units were encased in a shell of skimmed plasterboard. Ikea stainless steel door fronts were added to hide the washing machine and dishwasher.
For a vibrant effect, Walker-Dack recovered his Heal's sofas from a previous home with brightly coloured fabrics. The sofas surround two Conran coffee tables, one sitting on the other.
'When they were put side by side I didn't like them, so I had to use them as they had been displayed in the shop,' he says. The apartment has a definite identity - each area is distinctly separated, but details from one area are echoed in other parts.
The gold leaf on the wall cupboard, which is made from railway sleepers and houses Walker-Dack's stereo unit, is mirrored by gold picture frames in the kitchen.
The boxed-in bedroom on the canal side of the property also has an acidetched glass door.
'When I live here I am working hard on the Designer Warehouse Sales,' says Walker-Dack. 'So although I want a dramatic-looking place, it also needs to be a place in which I can relax. It has to be neat and ordered, too.
'I love this place. Away from main roads, sitting next to the canal, the tranquillity is disturbed only by the noisy Canada geese.'
